Who these terms are with

welcome-realestate.com is the personal website of Machhendra Thapa, a licensed Colorado real estate Broker Associate. Real estate brokerage services are provided through West + Main Homes, 2590 W Main St, Littleton, CO 80120. Using this site means you accept what follows. If you do not, please do not use it.

Using this site does not make you a client

This is the most important paragraph on the page. Reading this website, sending a message through the contact form, or receiving a reply does not create a brokerage relationship. No one becomes your agent, and no duties of agency arise, by way of this site.

In Colorado, a working relationship with a real estate broker is established through written agreement and the required written disclosures, provided and signed before that relationship begins. Until that has happened, treat anything you read or are told here as general information, and understand that you are not represented.

Please also do not send confidential information before a relationship exists. Anything you send in advance of a signed agreement cannot be treated as confidential client information, and in a transaction where another party is represented, it could work against you.

What the content here is, and is not

The pages, neighborhood guides, and articles on this site are general information, written to help you think about a decision. They are not legal, tax, financial, engineering, structural, or inspection advice, and they are not a substitute for a professional you have hired.

Nothing here is an offer to buy or sell property, or a solicitation of an offer. Property is bought and sold through contracts, not web pages.

Content is written carefully and corrected when it is found to be wrong, but it is written at a point in time. Markets, rules, tax treatment, and lending terms all change. Verify anything you are about to rely on, and get advice specific to your situation from someone who knows it.

Fair housing

This site and the services behind it are offered in accordance with the federal Fair Housing Act and the Colorado Anti-Discrimination Act. Federal law prohibits housing discrimination on the basis of race, color, religion, sex, disability, familial status, and national origin.

Colorado protects more than federal law does, and it is worth knowing which: alongside the federal classes, Colorado covers creed, ancestry, marital status, sexual orientation — defined to include transgender status and gender identity — military status, and source of income. Source of income has been a protected class in Colorado housing since 1 January 2021, which in practice means a housing voucher is not a lawful reason to refuse someone.

A practical consequence worth stating plainly: questions about the “kind of people” in a neighborhood cannot and will not be answered, by law and by preference. Questions about buildings, streets, zoning, schools as published data, and what a house will cost you to own — those are the whole point, and get answered fully.

Acceptable use

Please do not use this site to break the law, to harass anyone, to send malware, to attempt unauthorised access, to scrape it at a volume that degrades it for other people, or to harvest contact details for unsolicited marketing. The contact form is for people who want to talk about property.

Content ownership

The writing, photographs, and design on this site belong to Machhendra Thapa or are used with permission. You are welcome to read it, print it for your own use, and quote a reasonable extract with a link and attribution. Republishing it wholesale, or passing it off as your own, is not permitted.

“West + Main Homes” and the REALTOR® mark belong to their respective owners and are used here to identify the brokerage and professional membership accurately.

Where this site links out, it is because the destination was useful when the link was written. Those sites are not controlled from here; their content, accuracy, and privacy practices are their own. A link is not an endorsement, and it is not a guarantee that the page still says what it said.

Availability, and the limits of what can be promised

This site is provided as it is. It is maintained attentively, but it is not promised to be uninterrupted, error-free, or permanently available, and no warranty is given beyond what the law requires and does not allow to be disclaimed.

To the extent Colorado law permits, liability is limited for losses arising from use of this site or reliance on its general content. Nothing here limits liability for fraud, for a broker’s statutory duties to an actual client, or for anything else that cannot lawfully be limited — and nothing in these terms reduces the obligations owed to you once you are a client under a signed agreement.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Disputes belong in the state or federal courts located in Colorado.

Complaints about a licensed broker

Colorado real estate brokers are licensed and regulated by the Colorado Division of Real Estate, part of the Department of Regulatory Agencies. If you ever have a concern about the conduct of a licensed broker, including this one, the Division is where it goes, and pointing that out here is deliberate.

Changes

These terms may be updated. The current version always sits on this page with its date at the top; continuing to use the site after a change means the updated terms apply.
